Anastasia Beverly Hills, LLC (“ABH”) Professional Makeup and Esthetician Pro Program (“ABH PRO” or the “Program”) Terms and Conditions.
Available for (“Qualified Individuals”):
- Makeup Artists with Portfolios;
- Licensed Professionals; and
- Beauty School Students

Please read carefully. By participating, you agree to the following rules governing the ABH PRO Discount Program, including, where permitted, binding arbitration if any disputes involving your purchases or participation. By participating in the Program you understand and agree that you may be waiving certain rights, such as your right to bring an action in court and your right to have disputes decided by a judge or jury.
You need not join to purchase products at www.anastasiabeverlyhills.com.
If you do not agree with these rules, please do not enroll. Overview of the ABH PRO Discount Program.
A. The Program is sponsored by ABH. Qualified Individuals (each a “Member”) receive discounts when purchasing products on www.anastasiabeverlyhills.com.
B. Membership benefits are valid only at www.anastasiabeverlyhills.com.
2. General membership guidelines.
A. Membership in the Program is voluntary.
B. Membership is nontransferable.
C. By enrolling in the Program, a Member agrees to (i) this terms document which governs the Program and (ii) the website Terms of Use, which is incorporated by reference, available at https://www.anastasiabeverlyhills.com/pages/giveaway-terms-conditions (together collectively the “Terms”), as may be in force and published at ABH’s website and as may be changed at any time without notice.
D. Communications about the Program, including any changes, will be communicated by email or online at www.anastasiabeverlyhills.com.
E. Membership in the Program and its benefits are offered at ABH’s sole discretion.
F. ABH, may, at any time terminate, change, limit, modify or cancel the Program or any Terms or benefits of participation by posting the modified Terms at www.anastasiabeverlyhills.com. Your continued membership in the Program after such posting will constitute your acceptance of the new Terms.
3. Eligibility.
A. The Program is open to residents of the fifty (50) United States, excluding Puerto Rico, and District of Columbia.
B. Members must be at least 18 years old when they register.
C. Members must also be makeup artists with portfolios, licensed cosmetologists or licensed estheticians, models, influencers/ content creators, performers, or students who provide and maintain a valid email address and provide all required documentation as listed in the Program’s Requirements https://www.anastasiabeverlyhills.com/pages/abhpro .
4. Enrolling in the Program.
A. To apply for the Program, go to https://www.anastasiabeverlyhills.com/pages/abhpro to complete and submit an application.
B. In order to apply you do not need to have an active ABH account. Registering for an account is free. Loyalty members joining ABH Pro Program must use their loyalty points. Existing loyalty points will be forfeited.
C. To enroll, you must provide your full name, mailing address, email address, phone number, and other application Requirements as listed https://www.anastasiabeverlyhills.com/pages/abhpro. Enrollment will be confirmed with a welcome message at the email address provided.
D. Members may only register for one (1) account per person and per email address. The person who is the authorized email account holder of the email address indicated when registering is deemed to be the Member.
5. Program benefits.
A. The Program membership is valid for twelve months (“Membership Period”) and will need to be renewed online at https://www.anastasiabeverlyhills.com/pages/abhpro. Credentials must be currently valid at time of renewal. Number of accepted members may be capped in ABH’s sole discretion.
B. Members receive a 40% discount for Artist, 30% discount for Beauty Community, 20% discount for Students on eligible products purchased. Each Member may spend a maximum of $500 daily spend limit and $10,000 within a 12 month period from the date you are approved. Order that would bring your annual spend above $10,000, please contact Customer Service to provide justification and receive further assistance with your order.
C. The ABH PRO discount cannot be applied to items marked as new or sale on www.anastasiabeverlyhills.com. Loyalty rewards, discounts, codes cannot be used towards ABH Pro orders.
D. Program benefits apply solely to purchases made on www.anastasiabeverlyhills.com and at ABH salons. Purchases at ABH counters in retail stores, pharmacies or other third party retailers and e-tailers are not eligible.
E. ABH reserves the right to change the discount percentage for purchases at any time during the Program.
F. ABH may make offers selectively available to Members, based on purchase activity, geographic location, Program participation, or other factors.
G. From time-to-time, ABH may also provide Members with an opportunity to earn additional benefits through participation in site activities, such as watching videos, posting reviews/uploading user content (“User Generated Content”) in social media.
H. Products purchased by Members using their discount benefit are for the Members’ personal and professional use only and may not be resold or purchased for others under any circumstances.
I. Member may not sell or resell any of the products or samples thereof, you purchase or otherwise receive from us.
J. We reserve the right, with or without notice, to cancel the ABH PRO memberships, or reduce the quantity of any order to be filled or products to be provided to you, in ABH’s sole discretion at any time.
6. Duration of membership.
A. At the end of the Membership Period, Members must re-apply to the Program and provide all requested information and documentation.
B. In the event the Program is terminated early, a Member’s ability to use discounts will end.
C. ABH will advise Member of any change in Program timing by email or by posting updates to these Terms on the website.
7. User Generated Content. If Members choose to post comments regarding ABH PRO (“User Content”), you must follow these rules:
a. You must be at least 18 years old, the sole author and owner of any User Content posted;
b. You must disclose any material connection to ABH including receipt of free product samples for review purposes or other compensation or affiliation;
c. You must represent your sole opinion and it must be true and accurate;
d. You must have permission from any other person(s) featured in your submission;
e. You must not infringe on any patents, trademarks, trade secrets, copyright, right of publicity, privacy right or other right of any person or entity;
f. You must not include any information that references other websites or personal information such as addresses, email addresses, contact information, phone numbers, credit card information, etc. for you or anyone else that can be used to track, contact or impersonate that person;
g. You grant ABH, and its affiliates, a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use any intellectual property content that you post, such as photos and videos; and
h. All "moral rights" that you may have in the user posting has been voluntarily waived by you.
Because ABH does not review the substance of Member’s postings on ABH’s social platforms or other communications, every Member must be careful in dealing with other members to avoid fraud.
Each Member acknowledges that information provided by other Members may, despite the prohibitions set forth in these Terms, be harmful, inaccurate or deceptive. Authentication of the true identity of internet users is difficult. Therefore, ABH cannot and does not confirm that each Member is the person who they claim to be.
8. Returned purchases.
A. If an item is returned, the returned dollar amount will be added back to your quarterly account balance.
B. Returns will be processed in accordance with the www.anastasiabeverlyhills.com policy available at https://www.anastasiabeverlyhills.com/pages/shipping-returns.
9. Account activity.
A. Each Member is responsible for ensuring the accuracy of his/her account and should check his/her account regularly. Each Member is responsible for ensuring that the mailing address and the email address associated with his/her account is accurate and up to date. Member must contact ABH Pro team at abhpro@anastasiabeverlyhills.com to make changes to an account or account information. ABH is not responsible for any incorrect or inaccurate information supplied by any Member participating in the Program.
B. Upon termination of a membership/account for any reason, the account balance will be deleted.
C. Memberships/accounts cannot be transferred to another person.
10. Duplicate accounts.
a. Only one account per person per email address. If a dispute arises over ownership of an account, the registration will be deemed to have been made by the authorized account holder of the email address submitted at the time of enrollment. For purposes of these Terms, the "authorized account holder" is the natural person who is assigned to the submitted email address by an internet provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address.
b. If more than one (1) account is assigned to an individual, or if an individual opens more than one (1) account, the Member will only receive benefits for one (1) account. Duplicate accounts will be cancelled.
11. Inactive accounts
a. If an account is inactive for any given 365-day period, the Member's account will be deactivated, including elimination of any earned benefits. Inactivity is defined as no purchases made or no account renewal on www.anastasiabeverlyhills.com. In order to reactivate an account a Member must reapply to the Program.
b. ABH reserves the right to deactivate a Member’s account in cases of misrepresentation, fraudulent activity, abuse of the ABH PRO program, or technical or operational issues that impact the integrity of the Program at ABH’s sole discretion.
12.Membership cancellation. You may cancel your membership in the Program at any time by contacting ABH Pro support team or submitting your requests https://www.anastasiabeverlyhills.com/pages/customer-service.
13.Communication.
a. As a Member, you will periodically receive emails from ABH.
b. You may opt-out of the marketing emails at any time, but operational emails will still be sent to you as it relates to your membership in the Program. Examples of these are: the welcome email, a Program confirmation email, a monthly account update email, account renewal email or other communications that help ABH ensure that your account is reviewed. 14. Intellectual Property infringement.
a. Artwork, photography, and logos, including those for ABH used in conjunction with Program, on this web site or in print are copyrighted intellectual property of ABH. These materials must not be reproduced, replicated or doctored in any manner. All other materials, including text, photos, and design, is copyrighted by ABH and must not be reproduced elsewhere without explicit written permission. All sales and marketing brochures are to be used as references only and must not be duplicated, printed or reproduced for commercial use.
b. ABH reserves the rights to seek legal action against Members that infringe its copyrights, trademarks, and patents. Members must not manufacture, distribute or sell products that replicate the designs and functions owned by ABH. ABH will legally pursue all parties associated with the manufacturing, distribution, and sale of counterfeit or patent infringing products and services.
15.General Program conditions and exclusions.
a. ABH reserves the right in its sole discretion to cancel, suspend and/or modify the Program, or any part of it at any time.
b. ABH reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the registration process or the operation of the Program or to be violating these Terms. Any attempt by any person to deliberately undermine the legitimate operation of the offer may be a violation of criminal and civil law, and, should such an attempt be made, ABH reserves the right to seek damages (including attorneys’ fees) from any such person to the fullest extent permitted by law. ABH’s failure to enforce any term of these Terms will not constitute a waiver of that provision.
c. By enrolling in the Program, you agree to provide true, accurate, current and complete information about yourself and maintain and promptly update the information to keep it true, accurate, current and complete. If you provide any data that is untrue, inaccurate, not current or incomplete, or if ABH, in its sole discretion, believes that your registration data is untrue, inaccurate, or incomplete or that you are in any way abusing your membership in the Program, ABH reserves the right to suspend, terminate or refuse your participation.
d. Discounts are not valid unless earned in compliance with the requirements set forth and intended by ABH, and Member will not attempt to earn discounts by any means (including without limitation, by using any script, bot, data mine or other automated means) that only simulates applicable requirements. In the case of a dispute regarding the balance available to any Member, ABH’s decision will be final.
e. By enrolling in Program, you agree not to (a) take any action or (b) upload, post, submit or otherwise distribute or facilitate distribution of any user content (including text, communications, software, photographs, videos, sound recordings, data or other information) using any communications service, discussion forum, or other feature available on or through Program, in any manner, that is unlawful, deceptive, misleading, fraudulent, threatening, abusive, harassing, libelous, invasive of another's privacy, tortious, obscene, profane, infringes on any patent, trademark, trade secret, copyright, right of publicity, right of privacy, any other right of any party or which otherwise violates ABH’s site terms and conditions or any other agreement.
f. You further agree not to:
(a) upload any content that imposes an unreasonable or disproportionately large load on ABH’s computing, storage or communications infrastructure, or attempts to gain unauthorized access to the service, other accounts, computer systems or networks connected to the service, through password mining or otherwise;
(b) upload any content that contains software viruses or any other computer codes, files, or programs that are designed or intended to disrupt, damage, limit or interfere with the proper function of any software, hardware or network system or to damage or obtain unauthorized access to any system, data or other information of Sponsor, or any third party;
(c) create Member accounts by any automated means or under false pretenses or impersonates any person or entity, including an employee or representative of Sponsor; or
(d) harvest, scrape or collect any information from www.anastasiabeverlyhills.com.
g. Sponsor is not responsible for any incorrect or inaccurate information supplied by members while participating in the Program.
h. Program is not transferable in the event of death or divorce and does not constitute property of a Member.
16. Release. By participating in Program, each Member agrees to release and hold harmless ABH and its respective parents, affiliates, suppliers, distributors, advertising/promotion agencies, and offer suppliers, and each of their respective parent companies and each such company’s officers, directors, employees and agents (collectively, the "Released Parties") from and against any claim or cause of action, including, but not limited to, losses or damages of any kind, including personal injury, death, or damage to or loss of property, arising out of participation in the offer or receipt or use or misuse of any product or coupon.
17. Limitation of liability.
a. ABH is not responsible for incorrect or inaccurate transcription of information, for problems related to any of the equipment or programming associated with the Program or utilized by the Member, for any human error, for any interruption, deletion, omission, defect, or line failure of any telephone network, cellular network, or electronic transmission, for problems relating to computer equipment, software, inability to access the website or online service, or for any other technical or non-technical error or malfunction.
b. In the event of a printing error or irregular packaging, neither ABH nor respective related companies, parents, subsidiaries, affiliates, and respective agents and their agencies, suppliers and other companies involved in the development or execution of the Program or the production or distribution of Program materials ("Releasees") will have any liability.
c. Subject to applicable law, under no circumstances, including, but not limited to, negligence, will any of the Releasees be liable for any direct, indirect, incidental, special or consequential damages arising out of the Program or merchandise offered through the Program, even if any or all of the foregoing or any of their authorized representatives have been advised of the possibility of such damages.
d. If the Sponsor improperly denies a Member any discount, liability will be limited to the equivalent value of discount.
e. By participating in the Program, a Member waives any and all rights to bring any claim or action related to such matters in any forum beyond one year after the first occurrence of the kind of act, event, condition or omission upon which the claim or action is based.
f. Members agree to rely solely on the manufacturer's warranties, if any, for any products redeemed through this Program.
g. Subject to applicable law, by participating in ABH’s discount program, each Member hereby releases the Released Parties from and against any and all claims, damages, losses, liabilities, and other expenses (including, without limitation, attorney’s fees) relating to that Member’s participation in Program, use of points or rewards, or agreement to these Terms. ABH is not responsible for requests or correspondence lost or delayed in the mail.
18. Arbitration/choice of law.
a. This Program and these Terms will be governed by and construed under the substantive laws of the State of California, without reference to conflict-of-laws considerations.
b. Agreement to Binding Arbitration. ABH and Member (each a “party” and collectively “parties”) each agree that any dispute, claim, or controversy arising from or relating to this Program, these Terms, or Member’s ABH PRO membership will be resolved by binding arbitration conducted in Los Angeles, California under the then-existing commercial arbitration rules of JAMS using one arbitrator. ABH and Member each acknowledge and agree that each has chosen arbitration rather than litigation to resolve any such dispute, claim, or controversy. ABH and Member each understand that a judgment on any arbitral award may be entered in any court having jurisdiction. No arbitration under this Program and these Terms will be consolidated with any other arbitration.
c. Excluded Claims. Notwithstanding the parties’ decision to resolve all disputes through arbitration, either party may bring an action in state or federal court that only asserts claims for patent infringement or invalidity, copyright infringement, piracy, moral rights violations, trademark infringement, and/or trade secret misappropriation. Excluded claims are subject to the governing law provision above. Either party may also seek relief in a small claims court for any individual disputes or claims within the scope of that court's jurisdiction. If an arbitration is filed, before the arbitrator is formally appointed, either party can send written notice to the opposing party and the applicable arbitration provider that it wants the case decided by a small claims court, after which the arbitration provider may close the case.
d. Seeking Arbitration. If you elect to seek arbitration or file a small claim court action, you must first send to us a written notice of your claim (“Notice”). The Notice to us must be sent to: info@anastasiabeverlyhills.com . If we initiate arbitration, we will send a written Notice to an email address you have previously provided to us, if available. We may also use any other means to contact you, including a message in your Account. A Notice, whether sent by you or by us, must (i) describe the nature and basis of the claim or dispute; and (ii) set forth the specific relief sought (“Demand”). If you and we do not reach an agreement to resolve the claim within thirty (30) days after the Notice is received, you or we may commence an arbitration proceeding or file a claim in small claims court. Arbitration forms can be downloaded from www.jamsadr.com.
e. Fees. You and we agree that for any arbitration you initiate, you will pay the filing fee up to US $250 and we will pay the remaining JAMS fees and costs in accordance with the JAMS Rules. For any arbitration initiated by us, we will pay all JAMS fees and costs.
f. Award. In the event arbitration awards you damages of an amount at least US $100 greater than our last documented settlement offer, we will pay your awarded damages or US $2,500, whichever is greater.
g. Hearing. If your claim is for US $10,000 or less, we agree that you may choose whether the arbitration will be conducted solely on the basis of documents submitted to the arbitrator, through a telephonic or video hearing, or by an in-person hearing as established by the JAMS Rules. If your claim exceeds US $10,000, the right to a hearing will be determined by the JAMS Rules. In the event the arbitration will be conducted solely on the basis of submitted documents, the arbitrator’s decision and award will be made and delivered within six (6) months of the selection of the arbitrator, unless extended by the arbitrator. Except as expressly set forth herein, the payment of all filing, administration, and arbitrator fees will be governed by the JAMS Rules.
h. Injunctive Relief. Notwithstanding the foregoing, you and we both agree that you or we may sue in court to enjoin infringement or other misuse of intellectual property rights or in other scenarios where injunctive relief is appropriate.
i. Severability. In the event a court or arbitrator having jurisdiction finds any portion of these Terms unenforceable, that portion shall not be effective, and the remainder of these Terms shall remain effective. No waiver, express or implied, by either party of any breach of or default under these Terms will constitute a continuing waiver of such breach or default or be deemed to be a waiver of any preceding or subsequent breach or default.
j. Confidentiality. You and we shall maintain the confidential nature of the arbitration proceeding and the award, including the hearing, except as may be necessary to prepare for or conduct the arbitration hearing on the merits, or except as may be necessary in connection with a court application for a preliminary remedy, a judicial challenge to an award or its enforcement, or unless otherwise required by law or judicial decision.
k. 30 Day Right to Opt Out. You have the right to opt-out and not be bound by the arbitration agreement in this Section by sending written notice of your decision to opt-out to the following email address: info@anastasiabeverlyhills.com, using the subject line “Arbitration Opt-Out.” The notice must be sent within 30 days of the date on which you first became subject to these Terms; otherwise you shall be bound to arbitrate disputes in accordance with the terms of this Section. If you opt-out of these arbitration provisions, we also will not be bound by them.
l. California Residents. If you are a California resident, you will not be required to pay the fees and costs incurred by the opposing party if you do not prevail.
19. Privacy. Your privacy is important to us. Enrollment information collected by the Program will be processed in accordance with ABH’s privacy policy available at Privacy.
